ARAS Harley-Davidson Raffle - Official Rules
All proceeds benefit the Sponsor, a private non-profit 501(c)(3) organization.
Angel’s Rest Animal Sanctuary (ARAS) is a charitable organization whose mission is “Saving lives one companion animal at a time.” This is accomplished by providing a “retirement home” for animals that are unwanted or otherwise deemed unadoptable by other agencies and have no place to go. ARAS specializes in “underprivileged” animals, those in imminent danger of being euthanized because they are critically ill, old, disabled, have suffered emotional trauma or have special needs. ARAS provides every animal that enters their facility with the medical attention, therapy, nutritious/palatable food, love, care and, most importantly, respect and dignity they deserve.
PURCHASE
For each $25.00 purchase, a single raffle entry will be generated for the entrant. For each five entries purchased in a single transaction by one entrant, a sixth entry will be generated for the entrant at no additional cost to the entrant. Checks or money orders should be made payable to Angel’s Rest Animal Sanctuary. An “entry” shall not occur and be binding on the Sponsor until funds received for the same have cleared the bank. Raffle entries may be purchased in person from an Angel’s Rest Animal Sanctuary representative at one of the participating locations listed on the website www.angelsrestanimalsanctuary.org. Entry sales will commence on July 15, 2012, at 12:01 a.m. local Cincinnati time and will cease at 11:59 p.m. local Cincinnati time the day prior to the drawing, or at the time that all tickets have been sold.
Each purchase shall constitute an “entry” into the raffle drawing, and the person to whom the entry is registered shall be the “entrant.” Although, more than one name may be provided on the entry registration form, the entry shall be registered to the first name listed, who shall constitute the sole entrant for that ticket. The winning entrant shall be the “winner” of the prize. Transfer of prize ownership will be made to the winner. It is the sole responsibility of the winner to allocate a winning prize to other participants in case of a multiple entry registration, and the winning entrants shall hold harmless the Sponsor on conflicting claims or disputes among multiple claimants.
VOID WHERE PROHIBITED OR RESTRICTED BY LAW
This raffle is conducted in accordance with the gaming laws enacted and enforced by the State of Ohio and is void in areas prohibited or restricted by law. Raffle promoters and/or the Sponsor are not responsible for lost or stolen entries. Raffle entries will be disqualified, at the sole discretion of the Sponsor if any attempts are made to disrupt the raffle or circumvent the terms and conditions of these Official Rules. If the above occurs, the Sponsor reserves the right to remedy any such action, disruption, or circumvention in a manner, determined solely by the Sponsor, to be fair and equitable to raffle participants. The Sponsor may, at any time and without notice, modify, revise, or update the Official Rules to correct any errors, omissions or changes to the raffle, in their sole discretion. The Sponsor shall make all decisions related to the raffle in their sole discretion. By participating, the entrant agrees to be bound by these Official Rules and the decisions of the Sponsor and waive any right to claim ambiguity in the raffle operation or Official Rules.
The Sponsor, their members, officers, directors, agents and representatives and their parent organizations, affiliates, subsidiaries, and advertising, promotion and legal advisors are not responsible for and shall not be liable for: 1. Late, lost, delayed, damaged, misdirected, incomplete, illegible, or unintelligible entries; 2. Failed, returned, or misdirected notifications based on inaccurate information provided by the winner; 3. Telephone, electronic, hardware, or software program, Internet, or computer malfunctions, failures, or difficulties resulting from participation in the raffle or otherwise; 4. Errors in transmission; 5. Any condition caused by events beyond the control of the Sponsor that may cause the raffle to be disrupted or corrupted; 6. Any injuries, losses, or damages of any kind caused by a prize or resulting from acceptance, possession, or use of a prize, or from participation in the raffle; 7. Any printing or typographical errors in any materials associated with the raffle.
INTERNET
Due to postal regulations, raffle ticket stubs cannot be returned by mail for purchases over the Internet, through the mail or by telephone. When an order is placed, we will complete the ticket by filling in the name, mailing address, email address, and telephone number, and we will drop the ticket in the barrel at the drawing for the 2012 ARAS Harley-Davidson Raffle. At the drawing, the winner will be contacted based on the name and information on the ticket. To pick up the prize, two forms of identification, one of which must be a photo ID will be required to prove that this person is the person on the winning ticket. Purchasers do not need their ticket stubs for any reason; however, the stubs will be kept on file with the Sponsor’s Treasurer. Purchasers can email angelsrest@ymail.com or call (513)800-0738 to check when the order was processed and obtain their ticket number if so desired. Winner need not be present to win.
ELIGIBILITY
Entrants must be legal residents of the United States and 18 years of age or older on, or before, the drawing date. If an entrant’s check is dishonored prior to the drawing, the entry ticket will be declared invalid until a replacement payment is received. All checks found dishonored after the drawing must be honored. A $35.00 charge will be assessed for non-sufficient funds or stop payment checks. Winner may be required to complete an affidavit of eligibility/publicity release, which must be returned within 14 days of notification or an alternative winner will be selected.
DRAWING
A maximum of 2,000 entries will be sold for the raffle. The raffle will take place on September 16, 2013 (the “drawing date”), at approximately 5:00 p.m. local Cincinnati time, at Harley-Davidson of Cincinnati, 1799 Tennessee Avenue, Cincinnati, Ohio 45229. If not all tickets have been sold by the drawing date, the drawing date will be extended until all tickets have been sold and a new drawing date will be announced on the website www.angelsrestanimalsanctuary.org.
Sponsor reserves the right, in their sole discretion, to change the raffle drawing location, date, time, or ticket sale period. The winner does not need to be present to win and will be notified by the Sponsor within Seven (7) business days of the drawing. It is the responsibility of the entrant to provide a valid mailing address, telephone number and/or email address for notification. Entrants’ information will not be shared with any third parties, except that winner’s information must be provided to the Internal Revenue Service.
PRIZE
The winner of the prize will be awarded a 2013 or newer Harley-Davidson motorcycle with an official retail value of not less than U.S. $21,000.00, based upon the manufacturer’s suggested retail price at time of prize award. No conversion to cash privilege. Prize is not transferrable. The depiction of the prize motorcycle in any advertising or promotional materials may not reflect the actual motorcycle presented to the winner (and Sponsor shall use their best efforts to place said disclaimer on all applicable vehicle displays and other advertising or promotional materials depicting the prize motorcycle to be awarded). Sponsor, in their sole discretion, may substitute a different model motorcycle of equal or greater value.
The winner must claim their prize within 14 days from notification, per directions provided in the notification letter/email. Winner will be responsible for picking up the motorcycle on a date, time and site designated by the Sponsor.
Motorcycle will not be modified by the Sponsor to meet specific local, state or country requirements. Winner agrees to accept the vehicle as built for U.S. licensing and registration requirements. Winner will be responsible for any modifications required for import to a country outside of the U.S.
Failure to claim the prize within 14 days of notification results in forfeiture of the prize and the prize or its cash equivalent will be deemed to have been donated to the Sponsor for use by their charitable organization.
All
Federal, state and local income, sales and/or excise taxes, fees, assessments
and like charges associated with the prize, are the responsibility of the
holder of the winning ticket. The IRS has taken the position that amounts
donated for chances to participate in raffles, lotteries or similar programs
are not gifts and, therefore, the price of the entry does not qualify as a
deductible charitable contribution. Winner must complete an IRS Form W-9 before
receiving prize. For further information, consult your qualified
financial adviser. After
the end of the year, the Sponsor will file a Form W-2G with the IRS to report
the value of the prize. The winner will also
receive a copy of Form W-2G.
The Sponsor cannot give advice with regard to income tax consequences
or deductibility with respect to the raffle ticket purchases or the raffle
winner.
Entrants release the Sponsor, their board of directors, committee members, officers, volunteers, and representative agents from any and all liability with respect to participation in the promotion and possession of the prize. Any liability of the Sponsor shall be limited to the ticket purchase amount. In case of a dispute, the Sponsor’s decision shall be final. The Sponsor is not responsible for lost or stolen tickets.
Entrant agrees to allow Sponsor to use his/her name and/or image without any compensation for any promotional activity related to this or any future raffle. Any and all addresses and contact information of the purchaser will not be released to the public.
